Acceptance of Terms

By accessing the website https://bootsandcrampons.com/ or booking any trek, expedition, training program, or purchasing any service/product from Boots & Crampons Pvt. Ltd. (“Company”, “we”, “our”), you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

Nature of Activities & Acknowledgment of Risk

You acknowledge that trekking, mountaineering, and high-altitude expeditions are inherently dangerous activities that involve significant risks, including but not limited to:

  • Accidents, falls, or injuries
  • Altitude sickness (AMS, HAPE, HACE)
  • Extreme weather conditions
  • Natural hazards (rockfall, avalanches, landslides, etc.)
  • Equipment failure
  • Delays, route changes, or expedition termination

By participating, you voluntarily assume all such risks, including the risk of serious injury, permanent disability, or death.

Medical Fitness & Disclosure

  • Participants must be physically and mentally fit to undertake the activity.
  • Accurate and complete medical information must be disclosed at the time of registration.
  • The Company reserves the right to deny participation or remove a participant at any stage if deemed unfit, unsafe, or medically unsuitable.
  • No refund shall be provided in such cases.

Authority of Expedition Leader

  • The trek leader/expedition leader has absolute authority during the trip.
  • All decisions regarding safety, route, weather conditions, participant continuation, or evacuation are final and binding.
  • Non-compliance or misconduct may result in removal from the expedition without refund.

Itinerary Changes & Operational Flexibility

  • All itineraries are subject to change due to weather, terrain conditions, political situations, health concerns, or other unforeseen circumstances.
  • The Company reserves the right to modify, cancel, delay, or reroute any part of the trip in the interest of safety and logistics.
  • No compensation shall be provided for such changes.

Cancellation & Refund Policy

All cancellations, refunds, and rescheduling shall be governed by the Company’s Cancellation Policy, available separately on the website.

Payment Terms

  • Bookings are confirmed only upon receipt of the required advance or full payment.
  • Failure to complete payments within specified timelines may result in cancellation of booking without notice.

Insurance Requirement

  • Participants are strongly advised to obtain comprehensive travel insurance covering:
    • High-altitude trekking/mountaineering
    • Medical emergencies
    • Evacuation (including helicopter rescue)
    • Trip cancellation/interruption
  • For certain international expeditions, valid insurance may be mandatory.

Rescue, Evacuation & Associated Costs

  • In case of emergency, evacuation decisions will be made by the expedition leader or relevant authorities.
  • All costs related to rescue, evacuation (including helicopter rescue), medical treatment, and associated logistics shall be borne entirely by the participant.
  • The Company will assist in coordination but shall not be financially liable.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for:

  • Any injury, illness, death, loss, or damage suffered during the activity
  • Loss or damage of personal belongings
  • Delays, cancellations, or disruptions due to natural or external causes
  • Acts or omissions of third-party service providers

Participation is entirely at the participant’s own risk.

Assumption of Risk & Waiver

By participating, you expressly:

  • Assume full responsibility for all risks associated with the activity
  • Release and discharge the Company, its employees, guides, and affiliates from any claims, liabilities, or demands arising from participation

Personal Belongings & Gear Responsibility

  • Participants are responsible for their personal belongings and equipment.
  • The Company is not liable for loss, theft, or damage.
  • Any rented gear must be returned in proper condition; damages may be chargeable.

Code of Conduct

Participants are expected to:

  • Follow instructions of the expedition leader
  • Respect local culture, environment, and fellow participants
  • Avoid behavior that endangers self or others

Violation may result in removal from the trip without refund.

Environmental Responsibility

Participants must adhere to responsible trekking practices, including:

  • No littering
  • Respect for wildlife and natural surroundings
  • Compliance with local environmental regulations

Media Consent

The Company reserves the right to use photographs, videos, and other media captured during the trip for promotional and marketing purposes without compensation.

Force Majeure

The Company shall not be held liable for failure or delay in performance due to events beyond its control, including but not limited to:

  • Natural disasters
  • Weather conditions
  • Pandemics
  • Political unrest
  • Government restrictions
  • Strikes or transportation disruptions

Third-Party Services

Certain services (transport, accommodation, local operators, etc.) are provided by third parties. The Company acts as a facilitator and shall not be held liable for their acts, omissions, or deficiencies.

Website Usage

  • All content on the website is the property of the Company and may not be copied or used without permission.
  • Users agree not to misuse the website or attempt unauthorized access.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
